ELECTRONIC COMMUNICATIONS ON PRIVATE DEVICES ARE NOT PUBLIC RECORDS

A California Court of Appeal has held that written communications (including e-mail and text messages) sent or received by public officials and employees on their private electronic devices, and using their private accounts were not “public records” within the meaning of the California Public Records Act and therefore not subject to disclosure.
